The code of silence ends here

As outrage burns over the murder of George Floyd, my commitment to police reforms & accountability has never been stronger. I’m outraged because the actions of those officers do not represent our honorable profession. I’m outraged by the depravity shown by Derek Chauvin under the color of authority, and we all instantly knew every cop was going to wear that crime for a long time. Rightly so. 

Not because all or even most women and men who serve as police would ever condone such despicable behavior. That’s a given. What brands us is the internal malfeasance that keeps us from removing such people long before they commit their violent act or crime that stains everyone in a uniform. 

The video of George Floyd’s murder laid bare the complicity of our entire profession. We have insisted for decades that only bad apples commit the worst abuses. Any mention of those “bad apples” is met with strong protests and denials. It’s not me, it’s not me! We cry.

The last two weeks exposed the ugly underbelly of a law enforcement culture that has been tolerated far too long. The horror of George Floyd’s death showed us all the deeper systemic cancer: One truly criminal actor and the shock of three others who either did not care or did not feel empowered to stop him. No, police misconduct isn’t increasing, it is simply being videotaped. The ongoing civil unrest is policing’s collective penance for refusing to reform on its own.  

Good cops & police leaders: Just because you think there is no problem in your community doesn’t mean people of color feel the same. Understand you have blind spots. The civil unrest in your city should tell you things aren’t quite as rosy as you think. People who have been on the receiving end of rude, dismissive, aggressive, or abusive cops are walking around with unresolved pain and anger. Please hear the pleas of marginalized communities who have been crying out over mistreatment and abuse by people you know need to be removed from the police profession. 

We all know who they are. Line officers know who they are. Police managers and staff know who they are. There’s just never enough collective will to purge them. So, they remain among us like cancer, insidiously infecting the squads around them. Supporting a subculture that in practice counters and undermines the police mottos of protect and serve and all of our lip service about community policing. We have always pretended because they haven’t done something that rises to the level of criminality, their behavior can be ignored. Like our racist uncle who rants and we shake our heads, the time has come to acknowledge that the harm they do. The daily microaggressions they inflict on people are just as damaging to our professional credibility and when their conduct rises to outright criminal behavior? God help us, we’re seeing the result. 

Police leaders have failed our communities by failing to address this systemic, pervasive issue that they absolutely know exists. Why are so many disciplined officers allowed to resign and keep their certifications? How is it possible that there are databases of cops known to have committed sexual misconduct or are flagged as criminals, and still walking around in uniforms? Why is there no leadership push for national standards to decertify bad cops? 

Why is it taking two weeks of rioting in the streets to get most of you to even acknowledge publicly that we have to make some changes? 

After Rodney King’s beating, evidence showed us LAPD officers sending racist computer messages like “gorillas in the mist.” Ten years later, I knew officers who used racist acronyms to remember the streets in the projects: AFRO SCUM. The investigations following Ferguson, Chicago, and Baltimore revealed continuing racial undertones. Minneapolis has a long, fraught history of police brutality in their city. Let’s not forget it is where Philando Castillo was murdered, even though he was a lawful gun owner and did everything the officer told him to do. 

These are truths. Police truths. It is no longer enough for any of us to say, “I’m not racist” or “I’m not that cop.” We refuse to look at our racist past in the eye and deal with it and it is long past time for our police culture to stop pretending race isn’t still a significant issue. The people of color in our communities still feel the undertow of bias in many encounters. They are frustrated by our collective failure to do anything meaningful day to day. We need to drop our defensive shields and get real with our fellow citizens.

And we have to start cleaning our own house. The cops that make every call harder because they piss the citizen off almost immediately. The cops that intentionally piss off the citizen so they can say, “Uncooperative. Back in service.” The supervisor who runs an entrapment traffic detail to stop cars in the black neighborhood. The jerk who purposely drives through puddles and splashes people just for fun. The one who “testilies” because the guy in the back seat probably got away with plenty of other stuff anyway. The non-stop microaggressions and indignities committed by these kinds of cops are festering wounds in minority communities. So, why are we surprised when the next shooting turns into a riot? 

The code of silence ends here, my friends. You may not have the power to fire a bad cop, but you must make it clear to your unprofessional peers that racism and abuse of power are not tolerated. They make your job more difficult and they endanger your safety every day. You also have the power to change the culture of your unions. If you think it’s wrong to protect bad cops, then make them stop doing it. If they are beating a drum of us vs. them, they are not truly protecting you, they are fomenting dangerous divisions that will endanger you further. 

I believe good cops want bad cops held accountable. The protests in the streets are demanding reforms and policies to help do just that. We all must be part of the solution. You must reject those among you who do not uphold the integrity of policing. You must speak. Follow your oath. Lead, though it may not be easy. Police leaders must help you by standing up and calling out the systemic failures that keep bad cops on the job. Taking these steps will earn community support. Community support and trust are what will make you safer.  

Please do not listen to those who tell you citizens hate you. Or that there is a war on cops. Policing has always been dangerous. The truly criminal will attack peace officers. They always have and always will. But the fact is policing is safer than it has been in decades. There is no war on cops. There is a war on bad cops. There is a war on abusive cops. There is a war on dirty cops. Rightly so. They are the criminal in your midst. 

To my fellow citizens, outraged over a seeming avalanche of videos showing murders and abuses of citizens at the hands of police. I hear you. Change must occur. It is unacceptable in a democratic, civil society, and should not happen. Sadly, it happens over and over. Police misconduct is a cancer and protests are the cure. As Dr. King famously said, “A riot is the cry of the unheard.” 

I believe the images of uniformed police officers callously murdering a man in their custody has finally awakened us for good. The time has come for real change at long last. Keep up the fight, but do it peacefully. We’ve had lots of examples of good cops kneeling & expressing solidarity with you. Let’s build on those connections. Hold those who do not deserve the public trust to account. Let’s demand justice and control over how we are policed. That’s how it works in a democracy. You have the entire world’s attention. Let’s finally achieve the dream of justice.

The Pulse Massacre is a Hatecrime

All across our country and the world huge crowds have gathered in solidarity and grief remembering the victims of the Pulse Nightclub Massacre. When I see those crowds, I am humbled and moved to tears. Rainbow flags and messages of love flow freely without fear, purposely defiant, asserting that love will win. But I also hear others say we shouldn’t focus on the fact that the Pulse nightclub was targeted by an Islamic extremist because it is an iconic & popular gay bar in Orlando. We hear that we can’t possibly know that the location was targeted because it was an LGBT club, and it shouldn’t matter. We’re all Americans they insist.

On the surface this sounds great. I would love nothing more than to believe that LGBT Americans like me would be completely accepted into the fold of my country. But, that’s not what’s happening here. To dismiss the fact that this is a hate crime is plain wrong. To try to smooth over the fact that LGBT hate is one common thread between extremists in both Muslim and Christian Faiths is disingenuous, to say the least. This terrorist has been quoted as making statements of anger about seeing two men kiss, and in his Muslim associations, there is a focus on anti-gay teachings and bias. The LGBT community has been the target of nearly universal hate throughout history. That hate has been justified by religions all over the world. Just the past few months have seen scores of anti-gay legislation introduced throughout this country. In The United States of America, we are supposed to be different, our religious tolerance is supposed to guarantee the right of every citizen the freedom to worship, live, and love.

Although gay Americans finally won the right to marry a couple of years ago, most of us would still be hesitant to do something as simple as holding hands in public. For my friends and family who still don’t understand why there is a need for laws to protect gay people, that is how simple it is. I can’t even hold my wife’s hand in public for fear that someone might be offended and want to physically harm us. That is what makes this attack so insidious. For many LGBT people, a place like Pulse is one of the few havens from an otherwise homophobic and violent world. Saturday night’s attack changed that perception of safety. That’s what terrorists seek to do. They want to kill in places where we feel the most vulnerable. Pulse was perfect for this hellish objective. No different than attacking a church or synagogue or mosque. And just like the congregations of those places of worship, I hope that LGBT people will not let fear drive them from the places that offer affirmation, acceptance, and love.

When I see huge crowds forming in support for the victims of the Pulse massacre, I am hopeful. I’m hopeful that born out of this horrific tragedy will be a transformation, a realization that LGBT people are fully Americans, deserving of every right that most Americans take for granted. I’m hopeful that being Americans will the most important thing that binds us all together, and that we can forget about who I love and be glad we love just like you. Most importantly, we love our country every bit as much as you. Our LGBT DNA is another unique thread in the fabric of this great country, the diversity we have always celebrated as the strength that sets us apart from the rest of the world. That is what I hope to see—a recognition that we are equally American.

So, America, if we really want to make a statement of solidarity in the name of the victims in Orlando, let’s start by acknowledging the truth of the brazen hate crime against LGBT citizens. To be sure, if this had been an attack on a police station, we would of course say it was a terrorist targeting police officers. Let’s call the Pulse attack what it is: A hate crime and simultaneously the worst domestic terrorist attack in our history. To ignore the significance of the LGBT target is another way of minimizing the lives of LGBT people. Let’s all stand up to hate by being unafraid to say openly that 39 of our citizens were murdered and 40+ more were wounded because they were in a gay club. The victims were murdered not just because they were Americans, they were targeted because they were LGBT Americans. And all of America should say so.

The forced resignation of the police chief in San Francisco caused a bit of a stir in law enforcement circles recently. Chief Suhr follows a string of such actions, including the high-profile Superintendent in Chicago, and Chiefs in Baltimore and Ferguson. Chief Suhr and the others had long and distinguished careers by many accounts, and it is not my intention to disparage or throw stones at these men personally. However, it seems painfully obvious that doing business according to the status quo that has existed for decades is no longer working—for cops or the community.

In these contentious times, we need communication and leadership above all else. Policing in a democracy means change will always come as the public’s attitudes change over time. That’s reality. Law enforcement must always be flexible to adapt to those shifts, and leadership is supposed to drive change in a positive way. For instance, the 1966 Miranda ruling radically changed the rules for questioning suspects. No doubt, the chorus of doomsday predictors back then asserted that cops would never get another confession or make another case. Wrong. We worked smarter, adapted and got better at our jobs. We were fast and loose with stop and frisk, touting ever-increasing arrest and ticket numbers, but now we have to refocus on quality not quantity. Changes in pursuit policies and a host of other issues hasn’t ended law enforcement as we know it.

Our current reality is the proliferation of videos in our technology age that can celebrate outstanding police work, but also unfortunately exposes bad police behavior for the entire world to see. It’s not that those minorities of officers weren’t always there in our ranks, it’s just now harder to hide or ignore. That’s where we are today. So, law enforcement leaders have two choices: Rise to the occasion and drive positive change or lash out at anyone remotely questioning procedures and reinforce the status quo. Sadly, too many in leadership positions have chosen the latter.

The law enforcement leaders railing against any suggestion of change are not helping to bridge this divide with the community. I’ve seen these public servants say things like, “cops are afraid to do their jobs”, “cops are in a fetal position”, “cops are going to start sitting under trees”, or really incendiary things like “the mayor has blood on his hands”. Even the FBI Director has inferred that crime is rising because cops feel under attack. I have to shake my head. Some of these same leaders are the ones who sold the myth of statistical utopia, which pitted street officers against the communities they serve to begin with. Yes, these are difficult and stressful times, but fanning the flames and giving excuses to reactionaries who resist any change is not the answer. Lashing out against anyone who questions policing is not the answer. That’s not leadership.

Leadership requires honest self-examination and assessment for growth. Leadership requires that we reach across divides and listen to the communities we serve. Leadership urges the best officers to continue to do their best in spite of the noise around them, by reaffirming support for good work. We can’t partner with citizens if we continue to only look for blame externally rejecting any suggestion of self-critique or improvement. Criminals do kill more black citizens than police ever will. Yes. But that doesn’t excuse any cop from crossing the line. Law enforcement leaders need to re-evaluate and address our own shortcomings, not just whine about exposure of what we’d rather not have the public know. It is a shame that some in high-profile positions take such small-minded and defeatist attitudes. Their public statements pander to the worst behaviors, rather than the highest ideals of our profession. It’s lazy and wrong.

Forget leading from behind, that’s leading from the bottom.

Admitting the problem is the first step

At my retirement ceremony, given the opportunity to say a few words, I decided to end on this challenge: To my peers, I said don’t fall into the numbers trap, remember these are people you are serving, not numbers. I turned to the department staff and added: Please don’t forget the officers who work for you are people, not numbers.

A friend of mine asked recently what systemic changes could address the very contentious issues of policing and race in our country today. For me, it has to be reconnecting with people. To be sure, there are dangerous criminals and police officers must be ready to defend themselves, but most people are not. This affects even our interactions with average citizens and victims. We are taught to maintain this “safety distance”, and too often that morphs into a superiority buffer. The compassion I talked about last time dissolves in that defined space.

Early in my career, a homeless man was beaten and robbed. He was upset and desperate to have someone listen to him. In his emotional state, he grabbed my arm, begging me to hear him. My sergeant immediately shoved the man and chastised me for allowing him to touch me. I know he was thinking of safety, but I honestly, to this day, I do not think the man wanted to harm me.

As a new supervisor handling my first citizen complaint, I realized after speaking to the officer and citizen, the officer was wrong. The citizen, a calm, rational woman, wanted the officer to apologize. I asked him to do it. The woman was very satisfied and the complaint was resolved. Soon after, I was shocked when a colleague of mine told me I handled it wrong, saying flatly, “We don’t apologize.”

I’ve thought about this attitude a great deal with the recent scrutiny of law enforcement misconduct. I wonder, what are we so afraid of? Why can’t I do something as humane as giving a victim a hug if the situation warrants? Why is it wrong to simply acknowledge our shortcomings, fix the issues, and apologize, if applicable? I mean, if you and I are friends and I do something to hurt you or make you angry, the only way for us to really get past the harm is for me to acknowledge my actions and apologize. Right? Otherwise, I cannot regain my goodwill with you. It’s a very basic human dynamic. And law enforcement is all about human dynamics.

We are starting to see a change. In the video age, more officer misconduct is exposed, leading to more accountability. It’s a painful, positive step. I take no pleasure in seeing officers charged with felony crimes, but we cannot have a double standard. Most officers have integrity. Human mistakes can be fixed, but the profession loses credibility by ignoring or attempting to excuse those who do not. There are simply too many shocking videos to ignore the problem. Too many of these individuals have checkered histories or been allowed to move from agency to agency. Law enforcement has to own it and take credible steps to fix it.

Good cops should not be sorry to see the bad go. They only make your job harder and you and your peers less safe. Only when the entire police profession is willing to tackle systemic issues, be honest with the public at all times, and purge those who violate the trust of the badge will police be able to begin the process of repairing its crucial relationship with the citizens of our country. As retired NYPD Chief Phillip Banks said last week, “Cops hate two things: The way things are and change.” This change in thinking has to come, and it has to happen sooner than later. We can bridge this credibility gap. Fixing law enforcement’s house does not mean giving in to criminals. Accepting one’s flaws makes you stronger, not weaker. The first step to healing is always admitting the problem.

Numbers and Compassion Don’t Mix

This week, I read two good perspectives on empathy and policing by retired Chief David Couper and current D.C. Police Chief Cathy Lanier. Both rightly argued that empathy is something we are often lacking in modern policing—the ability to see things from another’s point of view. Chief Lanier points directly to policies of measuring performance by numbers as the reason for the empathy gap. From a street cop’s perspective, I couldn’t agree more.

When we all started going down the Compstat road, and police administrators started openly advocating treating our profession like a business counting widgets, things slowly began to unravel. Don’t get me wrong, Compstat has its place in identifying crime locations and determining where to put cops to fight that crime, but measuring those cops’ worth based on numbers is a path that soon puts the cops at odds with the entire community. The numbers-only system removes objectivity and most discretion, the two key ingredients in policing with compassion.

A friend of mine worked in a housing project known for notoriously high crime. After a series of shootings and other crimes, he was told to step up patrols in the area. The officer, knowing his zone, took the message to mean, stop the violent crime. He identified the key players, made a few good cases and removed the perpetrators from the neighborhood. At the end of the month, there were no shootings on his watch and crime was half what it had been! He should have gotten a citation for outstanding work, right? No. He was chastised for his lack of tickets and drop in arrests. (He had focused on the main criminals, and ignored minor crime). By policing with more discretion, he garnered greater trust and was able to get valuable information about crime from citizens. But, on the books, he looked like a slacker. Crazy, huh? The truth often is.

Another friend of mine was confronted with a dilemma on a traffic stop years ago. The driver of the car had a terrible driving record and his license was suspended so many times that he was considered a Habitual Traffic Offender, a felony at the time in FL. In this instance, the easiest—and many would say right—thing to do was for her to simply arrest the man and tow his car. But. There was an older woman in the passenger seat. The man bowed his head, telling the officer that his mother’s legs hurt so bad due to a medical condition that he risked going to pick her up to spare her the pain of walking home. My friend, after confirming the man had no other criminal background or warrants beyond the traffic fines, made a decision. She asked the woman if she had a valid license. She did. The officer then looked at the man and said, “I would do anything for my mom. I’m supposed to arrest you, but I’m not. Let your mother drive from here. Take care of your license. If I see you driving in another setting, I will arrest you. Fair?” The man was so grateful, he started to cry.

So, what’s the moral of the story? Technically, should my friend have taken the guy in? Yes. Did it really hurt anything for my friend to let him go? No. Do that guy and his mom now have a different perspective on the police? I’d say yes. In contrast, the officer with no compassion, simply “cuffs and stuffs”, indifferent to a personal story. When citizens become numbers, they cease to be people. Compassion is eliminated. Then, it’s a short jump to mistreatment or worse. For me, empathy and compassion are the two greatest traits of a good cop. In policing, we are too often told that those words equal weakness. That is fundamentally wrong. In fact, police are at their very best when they temper enforcement with compassion. Police leadership has to be bold enough to value empathy in the form of unconventional problem solving that cannot normally be measured like a pile of beans. It will take a little more work, but a community that sees its police as compassionate and just will support its police in times of crisis. Officers on the street are safer when community support is high.

Lessons of Ferguson-for the good of law enforcement

I promised to examine the Department of Justice report on the Ferguson Police Department, just as I did the DOJ’s report on the Brown shooting. The report on Ferguson got the lion’s share of headlines in the past couple of weeks, with most headlines shouting that the PD was engaging in racist behavior, illegal stops, and violations of civil rights. After reading the report in its entirety, which, again, I urge everyone to do, it’s painfully clear that Ferguson has some very troubling systemic problems. I’m not going to tap dance around saying “not every officer”, because common sense tells any intelligent person that’s a given, but the pervasiveness of the policies geared toward revenue generation and statistics alone, paint a picture of a police department in need of a major overhaul. City and Department officials were found to openly request more tickets written from the Chief to increase revenue. One DOJ example:

“City and police leadership pressure officers to write citations, independent of any public safety need, and rely on citation productivity to fund the City budget. In an email from March 2010, the Finance Director wrote to Chief Jackson that “unless ticket writing ramps up significantly before the end of the year, it will be hard to significantly raise collections next year. What are your thoughts? Given that we are looking at a substantial sales tax shortfall, it’s not an insignificant issue.”

Worse, officials were found to author and forward racist emails on city computers. When people are unafraid of being caught sending racist emails, I’d say the culture is evident. DOJ cites numerous examples throughout the report.

“We have found substantial evidence of racial bias among police and court staff in Ferguson. For example, we discovered emails circulated by police supervisors and court staff that stereotype racial minorities as criminals, including one email that joked about an abortion by an African-American woman being a means of crime control.”

Statistical analysis, combined with interviews of city and police personnel, examinations of public records, to include emails, provide numerous examples of improper practices of using the PD to generate revenues, and in some more damning examples, outright racist remarks in city correspondence. I’m a retired cop, so I’m concerned with the overall city leadership culture and performance standards (a sanitized way of saying quota) that make otherwise good cops do the wrong thing. It’s a slippery slope when leaders aren’t leading in a moral way. Here’s the DOJ take on it:

“The City’s emphasis on revenue generation has a profound effect on FPD’s approach to law enforcement. Patrol assignments and schedules are geared toward aggressive enforcement of Ferguson’s municipal code, with insufficient thought given to whether enforcement strategies promote public safety or unnecessarily undermine community trust and cooperation. Officer evaluations and promotions depend to an inordinate degree on “productivity,” meaning the number of citations issued. Partly as a consequence of City and FPD priorities, many officers appear to see some residents, especially those who live in Ferguson’s predominantly African-American neighborhoods, less as constituents to be protected than as potential offenders and sources of revenue.”

In other words, police officers in Ferguson understand that their job security depends upon those tickets. Sadly, they didn’t have a police chief strong enough or honest enough to stand up. Unfortunately, Ferguson isn’t alone in that leadership vacuum. The problem is that when you stop looking at tickets or other enforcement as the public safety instrument, and only consider the next “stat”, the person you encounter becomes less an individual and simply a number. I get that problem. I railed against stat-driven policing for years. Here’s the thing. Stats should never be an “outcome”. The only measure of police success should be the absence of crime in a community and the ability to work with the community to achieve that goal. Period.

The problem gets worse as it progresses. The City of Ferguson, like many other communities, sets a fine for minor offenses, with usually steeper, often criminal penalties for unpaid fines or failure to appear in court. Of course, when the cop on patrol stops the person again, they have a job to do. The person has a criminal offense or warrant. What’s the cop supposed to do? They have to arrest. It’s their job. So, then the citizen is booked into jail, and the cycle grows. Again, I get it. But, what is the police officer supposed to do at that point? It’s not the cop that sets the fines or criminalizes behavior. Our representatives pass laws that cops enforce. It’s just the cops who get the brunt of the blame for enforcing society’s rules. True story.

So, otherwise decent cops, just enforce the rules of society. The bad cops use the sketchy culture of a city like Ferguson, in ways that none of us want to acknowledge. But, just like I called on the Black community to face some tough thoughts last time, I challenge law enforcement not to look away. It’s a fact. A subpar or flat out bad cop uses stats as a cover for their bad behavior, and they can get away with it without strong leadership. If all his chain of command cares about is being at the top of the arrest/ticket stats, then nobody cares how the numbers come. I’ve seen it.

That, my friends in blue, is where we have to change. Now. Because the animosity that bad policies and policing sow, by even a few, get blown exponentially out of proportion, and the result is that it makes every cop on the beat less safe. Police officers must have the willing cooperation of the citizens to be effective. Sir Robert Peal said that at the dawn of our profession. With the proliferation of guns and violence in criminals today, that idea has never been more important. Our profession must have the courage to address systemic issues that lead to undesirable behaviors in our ranks. Our badge is a symbol of public trust. We have the responsibility to adhere to the ethics it represents and stand for justice.
